Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the mobile application TRUTH or DARE? Hot dirty party and any related services provided by Decentralized B.V. ("we", "us", or "our"). By downloading, installing, or using the app, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must not use the app or any related services.

App Store Terms

If you download TRUTH or DARE? Hot dirty party from the Apple App Store, you also agree to comply with the Apple Media Services Terms and Conditions. Your use of the app must remain consistent with those platform terms at all times.

Changes to These Terms

We may update or revise these Terms from time to time. When we do, we will update the "Effective date" shown below and may notify you via the app or other reasonable means. Changes take effect upon publication, and your continued use of the app after the changes are posted constitutes your acceptance of the revised Terms.

Limitations of Use

Subject to your continued compliance with these Terms, we grant you a limited, non-transferable, non-exclusive, revocable license to use the app for your personal, non-commercial entertainment purposes. You agree that you will not:

  • Modify, copy, distribute, decompile, reverse engineer, or attempt to extract the source code of the app or any part of it;
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the app;
  • Use the app to upload, share, or distribute unlawful, harmful, harassing, defamatory, obscene, or otherwise objectionable content;
  • Use the app in any way that violates applicable laws or regulations;
  • Use any automated means (including bots, scrapers, or similar tools) to access, monitor, or interact with the app;
  • Infringe the privacy, publicity, or intellectual property rights of any person.

Intellectual Property

All intellectual property rights in and to TRUTH or DARE? Hot dirty party, including but not limited to the app code, design, graphics, logos, text, and underlying technology, are owned by or licensed to Decentralized B.V.. Except for the limited license expressly granted to you under these Terms, you are not granted any rights, title, or interest in or to the app or its content.

Automatic Updates

The app may automatically download and install updates or improvements. By using the app, you consent to the receipt of such updates. If you do not wish to receive updates, you may need to uninstall the app from your device.

Data & Security

The app may store and process personal data in accordance with our Privacy Policy. You are responsible for keeping your device, operating system, and any access credentials secure. Jailbreaking, rooting, or otherwise modifying your device may compromise security and may cause the app to function incorrectly; we are not responsible for issues arising from such modifications.

Connectivity & Charges

Certain features of the app require an active internet connection. You are responsible for obtaining and maintaining the necessary network access. Any data charges, roaming fees, or other costs incurred through your mobile provider are your responsibility. If you are not the bill payer for the device, we assume that you have obtained permission from the bill payer to use the app.

Third-Party Services & Links

The app may integrate with or rely on third-party services, such as payment processors, analytics providers, or subscription platforms. These services have their own terms and privacy policies, which you should review. We are not responsible for the content, policies, or practices of third-party services or websites that are linked from or integrated with the app, and you access them at your own risk.

The app currently uses third-party services including:

  • AppHud (subscription and purchase management)

Liability

The app is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Decentralized B.V. disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or in connection with your use of the app, even if we have been advised of the possibility of such damages.

Accuracy of Materials

Content within the app is provided for general entertainment and informational purposes only. While we aim to keep the information accurate and up to date, we make no representations, warranties, or guarantees, whether express or implied, that any content in the app is accurate, complete, or current.

Notice Regarding Apple

If you use the app on an iOS device, you acknowledge and agree that:

  • Apple is not responsible for the app or its content;
  • Apple has no obligation to provide maintenance or support services for the app;
  • Any claims related to the app (including product liability, non-conformity with legal or regulatory requirements, or consumer-protection claims) are between you and Decentralized B.V., not Apple;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and
  • You are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

Right to Terminate

We may suspend or terminate your access to the app at any time, immediately and without notice, if we believe you have breached these Terms or engaged in fraudulent, abusive, or unlawful activity. Upon termination, your right to use the app will cease, and you must delete the app from your devices.

Severance

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in the Netherlands for the resolution of any dispute arising out of or relating to these Terms or your use of the app.
